NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKE.  PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

Eligibility: Sweepstake is open only to legal residents of the 50 United States and District of Columbia who are 21 years of age or older.  This Sweepstake is void where prohibited.   Employees, officers, and directors, and their respective immediate family members (spouse, parents, siblings, children) or household members (whether or not related) of Champignon North America, Inc. (“Sponsor”), and its parents, subsidiaries, affiliated companies, dealers, and wholesalers, their respective advertising and sweepstake agencies, and webmasters/suppliers are ineligible. By participating you agree to these Official Rules.

How to Enter: Beginning at or about 12:01 a.m. (ET) April 1, 2008, access the www.champignon-mini.com Web site, click on the icon, banner or text link to access the sweepstake registration page, and then follow the directions to enter. All Internet entries must be received and recorded by Sponsor’s computer (the official sweepstake time keeping device) by 11:59 PM ET on December 31, 2008. When online, you will need to accurately enter your full name, address, city, state, zip code, daytime phone number, e-mail address and age. No robotic, programmed, script, macro or other automated entries, or third party entries, (collectively “automated entries”), all of which will be disqualified.

There is a limit of one entry per person and/or e-mail address per day (12:00 AM ET to the following 11:59 PM ET). All entry information submitted becomes the property of Sponsor and will not be returned.

Prize Details/Odds of Winning: One Grand Prize, One Grand Prize Winner will be awarded a 2008 MINI Cooper with standard features and color as determined by sponsor.  Additional features available at winner’s expense. Approximate retail value of the Prize Package is $18,700.00. Verified Winner will be required to provide a valid driver’s license and proof of insurance before vehicle delivery.  Verified Winner will take delivery of vehicles directly from a dealership or provider designated by the Sponsor or the vehicle manufacturer. Verified Winner is solely responsible for applicable taxes, including but not limited to, sales tax, luxury tax, titling and licensing of vehicles, federal, state and local income taxes and any and all taxes associated with awarding of prize. Other dealer restrictions may apply. Vehicle will be awarded subject to applicable manufacturer warranties, but no other warranties apply. Vehicle delivery may take up to 120 days based on the dealership and the vehicle ordering process. Winner will take delivery and ownership of the MINI Cooper vehicle no later than 60 days after notification that of its availability at the dealership.  All costs and expenses not expressly stated are the sole responsibility of the winner.  Prize is non-transferable and no substitutions or cash redemptions will be made, except in case of the unavailability of the prize, Sponsor reserves the right to award a prize of equal or greater value. The odds of winning depend on number of all eligible entries received. 

Drawing: Winner will be selected via random drawing on or about 01/21/09 from all eligible entries received. Sponsor will attempt to notify potential winner by mail, overnight mail and/or telephone approximately two weeks after drawing.  The drawing and awarding of the prize will be conducted by sweepstake Mailing Center, Inc. an independent judging organization, whose decisions are final and binding in all matters relating to this sweepstake.  Properly claimed prize will be awarded, but in no event will more prizes be awarded than are provided for in these Official Rules.

General Terms and Conditions:  By entering, participants agree (a) that Sponsor, its parents, affiliates, subsidiaries, advertising and sweepstake agencies, and all of their respective officers, directors, employees, representatives and agents, (individually and collectively “Releasees”) are indemnified, released and will be held harmless by participants from any and all liability, for any damages, injuries or losses of any kind (whether due to negligence or otherwise) to person(s), including death, or property, arising directly or indirectly from the acceptance, possession, misuse or use of a prize or his/her participation in this sweepstake; and (b) winner grants (and agrees to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsor’s authority the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information at any time or times, in perpetuity, for advertising, trade, publicity and sweepstake purposes in any media now known or hereafter discovered, worldwide and on the World Wide Web and Internet, without review, notification, approval or additional compensation, unless prohibited by law. Winner may be required to complete, sign and return an Affidavit of Eligibility and Liability Release and, where lawful, Publicity Release within 14 days of receipt of notification.  If documents are not returned in a timely manner, or if prize notification or prize is returned as non-deliverable, or if the winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize will be forfeited and an alternate winner selected. By entering, participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the sweepstake, will be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules.  By entering, participants consent to the jurisdiction and venue of the federal, state and local courts in Englewood Cliffs, NJ. The information entrant discloses when registering for this sweepstake will be subject to the Privacy Policy set forth on the above Website.

Limitations of Liability: Releasees are not responsible for lost, late, stolen, illegible, misdirected, postage due or non-delivered entries, mail or e-mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Web site or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of,  any such information. Releasees are not responsible for any incorrect or inaccurate information, whether caused by Web site users, or by any equipment or programming associated with or utilized in this sweepstake and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Web site.  Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or operation of the sweepstake or Web site, to be acting in violation of the terms of the Web site or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person.  Releasees are not responsible for injury or damage to participants’ or any other person’s computer related to or resulting from participating in this sweepstake or downloading or copying materials from or use of Web site.  If, for any reason, the sweepstake is not capable of running as planned, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the sweepstake, and determine winner from eligible entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor.  Any attempt to deliberately damage any web site or undermine the legitimate operation of the sweepstake is unlawful and subject to legal action by Sponsor or its agents.  In case of dispute regarding entries, the authorized subscriber of email account used to enter the sweepstake, at actual time of entry, will be deemed to be participant and must comply with these Official Rules.  Authorized account subscriber is deemed to be natural person who is assigned an email address by an Internet Access Provider, online service provider, or other organization that is responsible for assigning email addresses.
